The Labor and Industrial Relations Commission (Labor Commission) is established by section 49, article IV, of the Constitution of Missouri. The Labor Commission’s primary constitutional duty is to be in charge of the Department of Labor and Industrial Relations (Department).

The Labor Commission is composed of three members appointed by the governor, with the advice and consent of the senate. Commissioner James Avery is classified as a representative of the employers on account of his previous vocation, employment, affiliation or interests. Commissioner Curtis Chick is classified as a representative of the employees on account of his previous vocation, employment, affiliation or interests. Commissioner William Ringer is licensed to practice law in the state of Missouri and is classified as a representative of the public by reason of his previous activities and interests. One member of the Labor Commission is designated by the governor as the chairperson of the Labor Commission. William Ringer currently serves as Chairman.

The Labor Commission nominates and the governor appoints, with the advice and consent of the senate, a director who serves as the chief administrative officer of the Department.

The Labor Commission has the authority to adopt rules for the management of the department and to approve the administrative rules promulgated by the Department and its Divisions. In addition to its oversight duties, the Labor Commission serves as a higher authority appeal board, reviewing appeals from workers’ compensation cases, unemployment insurance cases, crime victims’ compensation cases, and tort victims’ compensation cases. The Labor Commission also hears and determines objections to prevailing wage determinations and challenges to determinations by public bodies to enter into project labor agreements.
